Rental Terms and Conditions
MANDATORY GUEST REGISTRATION CLAUSE – ONLINE CHECK-IN COMPLETION BEFORE ARRIVAL
In accordance with Royal Decree 933/2021 of October 26 and Order IRP/418/2010 of August 5, all persons lodging are required to provide their personal details for registration in the system of the Generalitat Police - Mossos d'Esquadra. The information collected will be processed in accordance with data protection regulations and will be used exclusively to comply with applicable legal obligations.
To comply with this regulation:
· Registration obligation: It is essential that all guests over 14 years of age provide a valid identification document (ID card, NIE or passport) before entering the accommodation. For minors, the responsible guardian must sign indicating the relationship.
· Registration method: The check-in process must be completed online prior to arrival through the link sent by email within the GUEST AREA.
· Access condition: Failure to comply with this requirement may cause delays in accessing the accommodation.
ADDITIONAL INFORMATION
CHECK-IN/CHECK-OUT TIMES / INCLUDED SERVICES
· Check-out will take place between 8:00 and 10:00 (check-out at other times upon request and guarantee of a credit or debit card).
· Check-in will take place between 16:00 and 20:00 (early check-in before 16:00 is possible depending on the availability of the accommodation); for check-ins outside office hours, please contact us at (0034) 972 15 05 51 in advance or on the emergency mobile numbers.
· The agency is not responsible for any items or valuables left in the accommodation.
· Sheets and towels included. The towel service includes 1 bath towel per person + 1 hand towel per bathroom, extra towels cost €5 per towel. And the extra bedding pack costs €7 per person.
· Final cleaning is included, but does not include final cleaning of the kitchen (cleaning of dishes, pans, glasses, oven, refrigerator, barbecue, trash removal, etc.). In the event that the kitchen is not left in proper condition, we will be forced to charge €24 per hour of cleaning service, which will be deducted from the deposit.
· Not included and to be contracted separately if necessary: pet (if accepted in the accommodation, €14 per night and a maximum of €80 per stay), baby cot (0€ subject to availability and request), internet access: free.
MANDATORY TOURIST TAX PAYMENT
Adults: €1.00 per person per day. Maximum 7 days. Children and Young people under 17 (up to 16.99 years): €0.
Persons lodging in accommodation establishments located in Catalonia must register obligatorily. The national identity document will be mandatory upon entry, required from 14 years of age onwards. Article 2 of Order IRP/418/2010 of August 5, regarding the obligation to register and report to the General Directorate of the Police of persons lodging in accommodation establishments located in Catalonia.
CANCELLATIONS AND MODIFICATIONS
· Free reservation cancellation and modification: Up to 30 days before arrival.
· There will be no REFUNDS if the client voluntarily withdraws from the services before completing their stay.
· In case of cancellation due to force majeure (border closure), refunds may be made via a voucher valid for 18 months for the amount paid at the time of reservation cancellation.
· Exceptional drought situation whereby the implementation of measures to manage water scarcity in the territory is mandatory according to the guidelines of the Generalitat of Catalonia and other competent authorities. The regulation may affect services, without right to compensation.
CONTRACT TERMINATION
RESTAURANT SANTALLUCIA SL may automatically terminate the contract in the event of:
· The number of occupants in the accommodation exceeds the number of persons stipulated in the rental contract.
· Subletting and transfer of rights derived from this contract.
· Engaging in activities or causing disturbances that harm other neighbors, community rules, and general standards of decency, morality, and public order.
MODIFICATIONS AND LIABILITY EXCLUSIONS BY THE COMPANY
· In the event that, due to unforeseen circumstances not attributable to the company, the accommodation cannot be occupied, the company will provide the client with another accommodation of equal or superior characteristics without refunding any amount.
The company will not be responsible under any circumstances for:
· The theft, loss, or damage that guests may suffer during their stay in the rented apartment/house.
· Supply interruptions by electricity, water, gas, internet companies, etc.
· The breakage of appliances or any other device that is part of the accommodation; in this case, please notify the office so that the technical support service can be contacted to resolve the issue as soon as possible, but the lack of attendance or repair by this service will not be grounds for compensation by RESTAURANT SANTALLUCIA SL.
· The company is not responsible for the inconvenience, disturbances, or damage that may be caused by urgent works carried out on the street, neighborhood, or community during the rental period. These works may include, but are not limited to, emergency repairs, infrastructure maintenance, public works or any other intervention deemed necessary by the competent authorities or third parties.
GUARANTEES
Company authorized by the Generalitat of Catalonia. Guarantees of €72,000 deposited before public administrations. RESTAURANT SANTALLUCIA SL: Office at Av Diaz Pacheco 72, Almadrava, 17480 Roses, Girona, Spain.
DATA PROTECTION AND CYBERSECURITY CLAUSE
DATA PROTECTION: In accordance with the General Data Protection Regulation (GDPR) and other applicable legislation, we inform you that your personal data will be processed by RESTAURANT SANTALLUCIA SL, in order to manage your reservation and provide you with the requested services. The data will be kept for the time necessary to comply with legal and contractual obligations. You have the right to access, rectify, delete, restrict processing, data portability, and object to the processing of your personal data by sending your request to the postal address: Av Diaz Pacheco 72, Almadrava, 17480 Roses, Girona, Spain or via the email address info@santallucia.com
CYBERSECURITY: We are committed to implementing the necessary technical and organizational measures to guarantee the security of your personal data and to prevent its alteration, loss, processing, or unauthorized access, in accordance with the state of technology, the nature of the stored data, and the risks they are exposed to. However, we will not be liable for incidents that may arise concerning your personal data resulting from an attack or unauthorized access to our systems that is undetectable by the implemented security measures.
